Lunar Energy Installer App Terms of Service

These Terms of Service are a legally binding contract between you and Lunar Energy Limited regarding your use of the Lunar Installer application and related services.
1. Service Overview
The Service enables you to commission, service, test, configure, troubleshoot, swap, or decommission Devices. You may only use the Service to connect to a Device with prior authorization from the owner.
2. Eligibility
You must be at least 18 years old and authorized by an Installer. Lunar Energy retains the right to revoke access at any time.
3. Accounts and Registration
An account will be provisioned by or on behalf of an authorised Installer. You are responsible for maintaining credential confidentiality. Notify [email protected] if account security is compromised.
4. Licenses
Lunar Energy grants a limited, non-exclusive, non-transferable, revocable license to install and use the Application on one mobile device. You may not reproduce, distribute, or create derivative works of the Service.
5. Ownership; Confidential Materials
The Service and all Materials are owned by Lunar Energy or its affiliates. Documentation and instructions are Confidential Materials and must not be shared outside permitted use.
6. Third-Party Terms
The Service may enable export to Third-Party Offerings. Lunar Energy is not responsible for third-party use of exported information.
7. Your Data
You grant Lunar Energy a worldwide, perpetual, royalty-free license to process Your Data as necessary to provide the Services and for lawful business purposes.
8. Prohibited Conduct
You agree not to use the Service for illegal purposes, reverse engineer the Service, submit screenshots to generative AI offerings, or otherwise violate third-party rights.
9. Modification of Terms
Lunar Energy may change these Terms periodically. Material revisions are effective 30 days after posting for existing users.
10. Term and Termination
These Terms are effective when you accept or first use the Service. Violation of any provision automatically terminates your authorization. You may terminate by contacting [email protected].
11. Indemnity
You will defend and indemnify Lunar Energy Entities from claims arising from your unauthorized use, violation of these Terms, or violation of third-party rights.
12. Disclaimers; No Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." LUNAR ENERGY DISCLAIMS ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
13. Limitation of Liability
Lunar Energy Entities are not liable for indirect, incidental, special, consequential, or punitive damages. Aggregate liability is limited to US$100.
14. Governing Law
Governed by California law. Disputes subject to state and federal courts in Santa Clara County, California.
